1. Acceptance of Terms
By accessing or using StatusOwl ("the Service"), operated by StatusOwl ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
2. Description of Service
StatusOwl is an uptime monitoring platform that provides website, API, server, SSL certificate, and domain monitoring services. The Service includes real-time alerting, public status pages, analytics dashboards, and related tools. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
3. Account Registration
To use the Service, you must:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly notify us of any unauthorized access to your account
- Be at least 16 years of age
You are responsible for all activity that occurs under your account. We are not liable for any loss resulting from unauthorized use of your account.
4. Acceptable Use
You agree not to use the Service to:
- Monitor endpoints you do not own or have authorization to monitor
- Conduct denial-of-service attacks or generate excessive load against third-party services
- Attempt to circumvent rate limits, usage quotas, or other platform restrictions
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Impersonate another person or entity
- Interfere with or disrupt the integrity or performance of the Service
We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
5. Plans & Payment
StatusOwl offers free and paid subscription plans. For paid plans:
- Fees are billed in advance on a monthly or annual basis
- All fees are non-refundable except as required by law or as explicitly stated
- We may change pricing with 30 days' prior notice; changes apply at the next billing cycle
- Failure to pay may result in suspension or downgrade of your account
- You are responsible for any applicable taxes
Free plans are subject to usage limits as described on our pricing page. We reserve the right to modify free plan limits at any time.
6. Data & Privacy
Your use of the Service is also governed by our Privacy Policy. You retain ownership of any data you submit to the Service. By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service to you.
7. Status Pages
If you create a public status page, you are responsible for the accuracy of the information displayed. Status pages are publicly accessible and may be indexed by search engines. You may use a custom domain or a StatusOwl-provided subdomain for your status page. We reserve the right to display a small "Powered by StatusOwl" attribution on free-plan status pages.
8. Uptime & Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. Scheduled maintenance windows will be communicated in advance when possible. For paid plans with SLA guarantees, the specific terms are outlined in your subscription agreement.
9. Intellectual Property
The Service, including its design, code, features, documentation, and branding, is owned by StatusOwl and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written consent. "StatusOwl", the StatusOwl logo, and related marks are our trademarks.
10. Third-Party Services
The Service may integrate with third-party services (such as Slack, Discord, or email providers) for alert delivery. We are not responsible for the availability, accuracy, or practices of third-party services. Your use of third-party integrations is subject to their respective terms and policies.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT MONITORING CHECKS WILL DETECT ALL OUTAGES OR ISSUES.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STATUSOWL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless StatusOwl, its officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these terms, or your violation of any rights of a third party.
14. Termination
You may cancel your account at any time through the dashboard settings. We may suspend or terminate your account for violation of these terms. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after termination to allow for data export, after which it will be permanently deleted.
15. Changes to Terms
We may update these Terms of Service from time to time. Material changes will be communicated via email or a prominent notice on the Service. Continued use of the Service after changes take effect constitutes your acceptance of the revised terms. If you disagree with any changes, you should discontinue use and close your account.
16. Governing Law
These terms are governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these terms or the Service shall be resolved through good-faith negotiation before pursuing formal proceedings.
